You agree to defend, indemnify, and hold harmless BIG FOUNDATION, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers, and employees, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorneys' fees) arising from: I your use of and access to the Platform and/or the Service; (ii) your violation of any term of these Terms. This defence and indemnity duty survives termination of these Terms and your use of the Service and Platform.

No Spam Policy

These Terms prohibit sending unsolicited email ads or other unsolicited communications to BIG FOUNDATION email addresses or through BIG FOUNDATION computer systems. BIG FOUNDATION may monitor email usage using human monitors or automatic tools to spot spam or scam language in emails sent between BIG FOUNDATION users. Any communication between you and another user using the Service and Platform's communication features must follow the Terms. Unauthorized use of BIG FOUNDATION computers violates these terms and laws. Sender and agents may face civil and criminal consequences for such violations.

General Information

These Terms and other Platform policies constitute the complete and exclusive understanding and agreement between you and BIG FOUNDATION and govern your use of the Service and Platform, superseding all prior written or oral understandings, proposals, agreements, negotiations, and discussions between the parties. BIG FOUNDATION and you are bound by Indian law. BIG FOUNDATION claims must be filed in Ernakulam, Kerala, India. If you're a customer, another law may apply and a claim may be presented to another jurisdiction. BIG FOUNDATION's failure to enforce a right or provision of the Terms does not waive such right or provision. If a court finds any provision of the Terms unconstitutional (including because it's conflicting with the laws of another jurisdiction), the parties agree that the court should attempt to give effect to the parties' intentions as represented in the provision. If any of these Terms is found invalid, unlawful, or unenforceable, the validity, legality, and enforceability of the remaining Terms will not be affected. YOU AGREE THAT ANY CAUSE OF ACTION BROUGHT BY YOU AND RELATED TO YOUR USE OF THE SERVICE AND/OR THE PLATFORM MUST COMMENCE WITHIN A REASONABLE TIME AND IN ANY EVENT WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. A cause of action is barred otherwise. These Terms bind each party's successors and assigns.
